This Privacy and Cookies Policy (the "Policy") refers to the IDA Ireland websites www.idaireland.com (and IDA Ireland websites in other languages). The Websites are operated by the Industrial Development Authority (also known as IDA Ireland) ("we", “our” or “IDA"), whose principal place of business is at Three Park Place, Hatch St, Dublin 2, Ireland.

This Privacy & Cookies Policy (the "Policy") refers to the Industrial Development Agency (IDA Ireland) website www.idaireland.com. 
The purpose of this Policy is to provide you with information on how your personal data is processed and how to contact IDA Ireland in relation to the same. The IDA will process personal data in accordance with the following legal requirements (“Data Protection Legislation”):

  • The General Data Protection Regulation (EU) 2016/679 (“GDPR”),
  • The Data Protection Acts 1988 to 2018 and,
  • Any other applicable law or regulation relating to the processing of personal data (including the E-Privacy Directive 2002 (as amended) and the ePrivacy Regulations (S.I. No. 336/2011).

The personal data we receive may be received either directly or indirectly.

Directly: In some instances, you provide your personal data directly to us.  For example, if you act as an authorised representative of a Company, you may provide your contact details to IDA when filling in forms on this website, by submitting a query or when you correspond with us by phone, email or otherwise

Indirectly: In other cases, we may receive your personal data from your employer. For example, as part of the employment permit or visa application process.

  1. Legal basis for processing
To process your personal data, IDA must have a legal basis to do so. It is necessary for IDA to process personal data to fulfil its statutory functions under the Industrial Development Acts 1986–2019.
We only collect and use personal data where we have a lawful basis to do so. This may include circumstances where:
  1. we are legally entitled and/or required to do so, including in the performance of our statutory functions under the Industrial Development Acts 1986–2019;
  2. it is necessary for the establishment, exercise or defence of legal claims or proceedings;
  3. it is necessary to comply with legal and regulatory obligations;
  4. it is necessary for the performance of a contract between you and us;
  5. it is necessary for our legitimate interests;
  6. you have requested or consented to us processing your personal data
 
  1. With whom do we share your personal data?
  • Personal data is only shared with another controller or processor where it is necessary to do so and the sharing is compliant with the relevant Data Protection Legislation. IDA Ireland limits the personal data which is shared to what is strictly necessary to fulfil our statutory function, provide ancillary services to IDA Personnel or to comply with other legal obligations.
 
  • IDA is audited by external agencies including the Comptroller & Auditor General and the outsourced provider of internal audit services. Records containing personal data may be sought for review as part of audits undertaken. IDA Grants may also be audited by the European Commission.
 
  • It may be necessary to share personal data with third parties who provide a service to us including IT, maintenance, website hosting, analytical and marketing services. Any third parties who access your data while providing services on our behalf are subject to strict contractual restrictions to ensure that your data is protected, in compliance with data protection law. 
 
  • Where an Applicant Company transfers from the IDA portfolio to another state agency, a copy of the personal data relevant to an existing grant claim will be transferred also.
 
  • Your personal information will be included in IDA support letters for submission with your employment permit application.
 
  • Your personal information will be included in IDA support letters for submission with your AWS application.
 
  • We may also disclose your personal data in response to a valid, legally compliant request by a competent authority or in response to a court order or otherwise in compliance with the applicable law under which the request has been made.
 
  • In limited circumstances, IDA may share information with other EU or member state organisations where it is legally required or necessary to pursue a joint initiative or event.
 
  1. Where we store your personal data
All information you provide to us is stored on our secure servers or in manual form.
In certain circumstances your personal data may be transferred if IDA Ireland Personnel or service providers that are operating outside of the EEA are required to process this data to provide a service or interact with you, for example to access our CRM system to obtain contact details. Where any such transfer takes place, it will be subject to appropriate safeguards.

 
  1. Retention of personal data

Any information that you provide to us will be kept and stored for such period of time as we deem necessary taking into account the purpose for which it was collected in the first instance, and our obligations under Data Protection Legislation. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and Data Protection Legislation. In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

  1. What rights do you have?

The list below sets out the rights which you have in relation to data protection. Please note that these rights are not absolute and are subject to certain exemptions under applicable data protection law.

  • the right to know what personal data we process about you and how we use this personal data;
  • the right to obtain a copy of the personal data we hold about you;
  • the right to have any inaccurate personal data which we hold about you updated or corrected;
  • the right to have personal data concerning you deleted unless we are required to continue processing it;
  • the right to object to the processing of your personal data in certain circumstance;
  • the right to restrict the processing of your personal data in certain circumstances;
  • the right to transfer your data to another controller in a machine-readable format without hindrance in certain circumstances;
  • the right not to be subject to automated decision making which produces legal effects save for certain exceptions.

If you do not think that we have processed your personal data in accordance with this Policy, please contact us in the first instance at dpo@ida.ie. If you are not satisfied, you have the right to lodge a complaint with the Office of the Data Protection Commissioner or exercise any of your other rights pursuant to data protection law. This Policy may be updated from time to time, so you may wish to check it each time you submit personal data to us. The date of the most recent revisions will appear on this Policy.
